PewMag.com ("Platform," "we," "us," or "our") operates an online marketplace connecting independent sellers with buyers of digital design files for laser engraving and related fabrication.

By accessing or using pewmag.com, you agree to these Terms and Conditions ("Terms").

You must be at least 18 years old and legally capable of entering into binding contracts to use this Platform.

By using PewMag.com, you represent and warrant that:

• You meet these eligibility requirements
• All information you provide is accurate

PewMag.com acts solely as an intermediary platform facilitating transactions between buyers and independent sellers.

• PewMag.com is not the seller of third-party listings
• PewMag.com does not create, verify, test, or guarantee any files
• PewMag.com does not control seller content

All transactions are formed directly between buyer and seller.

The Platform operator may maintain separate seller accounts.

• Any such listings are offered as an independent seller, not as the Platform
• The operator, when acting as a seller, assumes the same responsibilities and liabilities as any other seller

By uploading or listing any file, sellers explicitly represent and warrant at the point of upload that:

• They own or have full legal rights to the content
• The content does not infringe any intellectual property rights
• The file is functional and accurately described
• The listing complies with all applicable laws

Sellers accept full legal responsibility for:

• Their content
• Any infringement claims
• Any disputes arising from their listings

PewMag.com does not verify ownership of user-submitted content.

• Sellers are solely responsible for IP compliance
• PewMag.com is not liable for infringing content
• Claims are handled under Section 19 (DMCA Policy)

Upon purchase, buyers receive a limited, non-exclusive, non-transferable license.

Permitted:

• Use files to create physical, engraved or manufactured products
• Sell those physical end products

Prohibited:

• Reselling, redistributing, or sublicensing the digital file
• Sharing files with any third party (including friends, employees, or collaborators who have not purchased a license)
• Uploading files to any sharing platform or cloud repository for distribution
• Modifying files for resale in any digital format

This is a license only, not ownership.

All products are digital files only. PewMag.com makes no guarantees regarding:

• Engraving results
• Machine compatibility
• Software compatibility
• Output quality

All files are provided "as-is".

Buyers acknowledge that they do not rely on any statements, representations, images, previews, or descriptions provided on the Platform when purchasing digital files.

All purchasing decisions are made at the buyer's own risk.

Files do not include machine-specific settings unless explicitly stated. Buyers are solely responsible for:

• Calibration
• Testing
• Safe equipment operation

Due to the nature of digital products, all sales are final.

Exception:

• Files that are corrupt or cannot be accessed/downloaded

Clarification:

• Sellers are expected to resolve valid file issues promptly
• If a seller fails to resolve a legitimate issue, PewMag.com reserves the right to intervene and issue a refund at its sole discretion

PewMag.com reserves the right to recover any amounts owed by a seller, including refunds, chargebacks, or fees, by offsetting such amounts against current or future payouts.

To the maximum extent permitted by law, PewMag.com shall not be liable for:

• Equipment or material damage
• Personal injury
• Business losses
• Poor engraving outcomes
• File defects or errors
• Intellectual property disputes

Total liability is limited to the amount paid for the product.

You agree to indemnify and hold harmless PewMag.com from any claims arising from:

• Your use of the Platform
• Your purchase or use of files
• Your violation of these Terms
• Your content (if you are a seller)

Users may not:

• Upload infringing or illegal content
• Share or redistribute purchased files
• Use files unlawfully
• Interfere with the Platform

PewMag.com may suspend or terminate accounts at any time.

PewMag.com reserves the right to:

• Remove listings
• Suspend accounts
• Modify services
• Refuse service

All at its sole discretion.

PewMag.com does not guarantee uninterrupted or error-free access to the Platform. We may suspend, restrict, or discontinue access at any time without liability.

Users are responsible for maintaining the confidentiality of their account credentials. PewMag.com is not liable for any loss or damage arising from unauthorized account access.

Include:

• Contact details
• Description of the work
• URL of infringing content
• Good faith statement
• Statement under penalty of perjury

PewMag.com may:

• Remove content
• Notify the seller
• Terminate repeat offenders

Payments are processed by third parties. PewMag.com:

• Does not store payment details
• Is not liable for payment processor issues
• Is not responsible for payment processor decisions, including holds, reserves, delays, reversals, or account restrictions

Your use of the Platform is also governed by our Privacy Policy.

Where applicable, users located in jurisdictions with data protection laws (including GDPR and CCPA) may have additional rights as outlined in the Privacy Policy.

To the fullest extent permitted by law:

• All disputes shall be resolved through binding arbitration, not court proceedings
• Arbitration shall take place in the Commonwealth of Virginia, USA, unless otherwise required by applicable consumer protection laws
• Users waive the right to participate in class actions

International Users:

If local laws require otherwise, disputes may be resolved in the user's jurisdiction, but these Terms shall still apply to the maximum extent enforceable.

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict of law principles.

For users outside the United States:

• You agree that U.S. law governs your use of the Platform, except where prohibited by local law

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

These Terms constitute the entire agreement between you and PewMag.com and supersede any prior agreements, communications, or understandings.

PewMag.com may update these Terms at any time. Continued use constitutes acceptance of updated Terms.
